These terms are written in English, and the English version is the binding one. Translations are provided for convenience. If a translation and the English version differ, the English version applies.
1. Who we are
FitTech-AI is provided by SAGUNI LTD, a company registered in England and Wales (company number 16511146), registered office 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ. These terms apply to app.fittech-ai.com, www.fittech-ai.com and the FitTech-AI apps for iPhone and Android (together, "FitTech-AI"). You can contact us at privacy@fittech-ai.com.
2. Who can use FitTech-AI
- You must be 18 or over to create an account or use the app.
- An account is for one person. Keep your sign-in secure and do not share it.
- Give accurate answers about your health, injuries and training, because your plan depends on them.
- The FitTech-AI apps can be downloaded worldwide. Lite and Plus are sold only to customers in the United Kingdom: on our website, through Apple In-App Purchase in the iPhone app, and through Google Play Billing in the Android app. What the App Store or Google Play offers you can also depend on your App Store or Google Play country or region.
3. Accounts and approval
New accounts are reviewed before they can use the app. We may refuse, suspend or remove any account at our discretion, including where these terms are not followed. You can delete your account at any time from More, Export, in the app.
4. Not medical advice
- FitTech-AI is a planning tool, not a doctor or physiotherapist. It does not diagnose, treat or replace professional advice, and it does not set calorie or macro targets.
- Speak to a doctor or physiotherapist before you start if you have a medical condition, an injury, pain, are pregnant, or are unsure whether exercise is safe for you.
- Stop and get medical help if you have sharp pain, pain that spreads down an arm or leg, numbness, chest pain, dizziness or anything that worries you. You are responsible for deciding what to do in each session.
5. AI-generated content
Plans, suggestions, coach replies and estimates of food, calories or workouts are produced with AI and can be wrong or incomplete. Nothing is applied to your plan until you review and accept it. Check anything that matters before relying on it.
6. Using the service fairly
Do not misuse FitTech-AI. That includes trying to get around sign-in, approval or usage limits, overloading or scraping the service, reverse engineering it, using it for anything unlawful, or uploading photos or content you do not have the right to share.
7. Your data
Your plans, logs and other content remain yours. You allow us to store and process them only to provide the service. How we handle personal data, including health information and health data read from your phone (clause 23), is explained in our Privacy Policy. You can export your data or delete your account at any time.
8. Plans and prices
FitTech-AI has a free plan and two paid plans, Lite and Plus. The free plan includes your first 12-week training programme, with every session, logging, editing your plan by hand and the exercise library. Any week you pause extends your free period by a week. After your free programme, starting a new programme and using the AI features require Lite or Plus.
Whatever plan you are on, you can log any session you do, log food by hand, record steps, complete check-ins, see your history and progress, export your data and delete your account. Anything you have already logged stays yours and stays visible.
Lite includes starting new programmes and the AI features, with smaller monthly usage allowances than Plus, and is available as a monthly plan only. The option for the AI coaches to use your own plan, food log and goals is part of Plus only.
On our website, Lite costs £5.99 a month and Plus costs £8.99 a month or £71.99 a year. In the iPhone app, Lite and Plus are sold through Apple In-App Purchase at App Store prices, which are different: at the date of these terms, Lite costs £6.99 a month and Plus costs £10.99 a month or £82.99 a year in the App Store. In the Android app, Lite and Plus are sold through Google Play Billing at Google Play prices, which are different again: at the date of these terms, Lite costs £7.99 a month and Plus costs £11.99 a month or £94.99 a year on Google Play. Prices are in pounds sterling and are the total you pay. Before you confirm any purchase, the purchase screen shows the total price, the billing period and how renewal works; that price applies to the period you buy. Later price changes are covered by clause 15. Lite and Plus are sold to customers in the United Kingdom; the free plan and the free trial are available wherever you are.
The usage allowances for each plan are shown on our pricing page and in the app.
Founding offer. Where offered, your first year of Plus costs £61.99 instead of £71.99. It applies to the annual plan bought on our website only, once per account, and your subscription renews at the standard annual price unless you cancel. It is not available on Lite or through the App Store. The offer may be withdrawn at any time, which does not affect a subscription already started.
Changing plan. If you subscribed on our website, you can move between Lite and Plus at any time through Manage billing. Moving from Lite to Plus takes effect straight away: you pay the difference for the rest of your current billing period, and your subscription then continues as Plus. Moving from Plus to Lite takes effect at the end of the period you have already paid for, and you can cancel that change before then to stay on Plus. If you subscribed through Apple, you change plan in the app or in your Apple account's subscription settings, and Apple applies the change and any adjustment to what you pay under its own rules.
9. Free trial of Plus
New accounts may be offered a 14-day free trial of Plus. No payment card is needed, no payment is taken, and the trial ends by itself. It is available once per account and only during your free programme. When it ends you return to the free plan, with everything you have logged intact. The trial works the same in the apps and never starts an App Store subscription.
10. Paying, renewing and receipts
On our website, payments are processed by Stripe. We do not see or store your card details. By subscribing you authorise us to charge the plan price to your payment method at the start of each billing period until you cancel.
Your subscription renews automatically at the end of each period, monthly or yearly as chosen, at the price then applying to your plan. Before you pay we show you the price, the billing period and, where a founding or promotional price applies, the price your subscription renews at. Stripe emails you a receipt for each payment and you can see your invoices at any time through Manage billing.
Payments through Apple. If you subscribe in the iPhone app, Apple takes the payment using the payment method in your Apple account, renews your subscription and sends your receipts, under Apple's own terms. We do not receive your card or bank details; Apple tells us which plan you bought and whether your subscription is active, so that we can provide it. An App Store subscription renews automatically at the end of each period unless you turn off automatic renewal at least 24 hours before the period ends. Apple's handling of the payment does not change our responsibility for providing FitTech-AI.
Payments through Google. If you subscribe in the Android app, Google takes the payment using the payment method in your Google account, renews your subscription and sends your receipts, under Google Play's own terms. We do not receive your card or bank details; Google tells us which plan you bought and whether your subscription is active, so that we can provide it. A Google Play subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends. Google's handling of the payment does not change our responsibility for providing FitTech-AI.
One subscription at a time. Your account needs only one paid subscription, bought on our website, through Apple or through Google Play. While one is active, we try to stop you buying another, but overlaps can still happen. If you are charged in both places for the same account, contact us and we will help you cancel the one you do not want. Cancelling stops future payments; it does not by itself refund earlier ones. Where we confirm that the same account was charged on our website and through Apple or Google Play for the same period, we will refund the overlapping part of the website payment, less any refund you have already received for that overlap. This does not limit any refund or remedy you are entitled to by law.
11. Cancelling
If you subscribed on our website, you can cancel at any time through Manage billing in the app. Cancelling stops the next payment; it does not end your subscription immediately. You keep your paid plan until the end of the period you have paid for, and then return to the free plan. We do not refund the unused part of a period except where clause 12 or the law requires it.
If you cannot reach Manage billing, email us and we will cancel it for you.
If you subscribed through Apple, cancel in your Apple account's subscription settings, which you can open from Account, Manage in the App Store, in the iPhone app, or at apps.apple.com/account/subscriptions. We cannot cancel an Apple subscription for you. Turning off automatic renewal normally leaves your paid plan in place until the end of the current period; it ends earlier if Apple refunds or revokes the purchase.
If you subscribed through Google Play, cancel in your Google Play subscription settings, which you can open from the Play Store app under Payments and subscriptions, Subscriptions, or at play.google.com/store/account/subscriptions. We cannot cancel a Google Play subscription for you. Cancelling normally leaves your paid plan in place until the end of the current period; it ends earlier if Google refunds or revokes the purchase.
12. Your right to change your mind
You normally have 14 days to change your mind about a digital service bought online. Because Lite and Plus are available to use straight away, when you subscribe on our website you ask us to start the service immediately and you acknowledge that you lose your right to cancel for a refund once it has started. We tell you this at the point of purchase and keep a record of your agreement.
Where the 14-day right does apply and you have not started using your paid plan, tell us within 14 days and we will refund you in full.
If you subscribed through Apple, the 14-day right is handled by Apple under its terms and your rights as a consumer. At the date of these terms, Apple's UK terms let you withdraw within 14 days of receiving your receipt, using Apple Account, Purchase History, Withdraw Transaction, except where supply has started at your request and you acknowledged that you would lose that right. Turning off automatic renewal is not the same as withdrawing or asking for a refund. Our website acknowledgement does not apply to a purchase made through Apple. If you need help, contact us.
If you subscribed through Google Play, the 14-day right is handled by Google under the Google Play Terms of Service and your rights as a consumer, except where supply has started at your request and you acknowledged that you would lose that right. Cancelling your subscription is not the same as withdrawing or asking for a refund. Our website acknowledgement does not apply to a purchase made through Google Play. If you need help, contact us and we will help you raise it with Google.
13. Refunds
Outside clause 12, we do not generally refund payments already made. We will refund you where we are required to by law, where a payment was taken in error, and where a fault on our side left your paid plan unusable for a significant part of a billing period. Contact us and we will look at it. Refunds go back to the payment method used.
Apple handles refunds of App Store payments; we cannot refund them through Apple's payment system. You can ask Apple at reportaproblem.apple.com, or use Apple's withdrawal process where it applies (clause 12). Apple's refund policies do not replace your legal rights: contact us about a fault with FitTech-AI or any remedy we are responsible for.
Google handles refunds of Google Play payments; we cannot refund them through Google's payment system. You can ask Google from your order history at play.google.com/store/account/orderhistory, or through Google Play support, or use the withdrawal process where it applies (clause 12). Google's refund policies do not replace your legal rights: contact us about a fault with FitTech-AI or any remedy we are responsible for.
14. If a payment fails
If a renewal payment on our website fails, your paid features stay on for 7 days while the payment is retried, and we will ask you to update your payment details. If it has not succeeded by the end of that period, your account returns to the free plan. Nothing you have logged is deleted.
If an App Store renewal fails, Apple retries it under its own rules. While Apple tells us your subscription is in a billing grace period, your paid features stay on. Otherwise your account returns to the free plan when Apple tells us the subscription has expired or been revoked. Nothing you have logged is deleted.
If a Google Play renewal fails, Google retries it under its own rules. While Google tells us your subscription is in a billing grace period, your paid features stay on. If the subscription goes into account hold, or Google tells us it has expired or been revoked, your account returns to the free plan until a payment succeeds. Nothing you have logged is deleted.
15. Price changes
We may change the price of Lite or Plus for reasons such as changes in what it costs us to provide FitTech-AI, in taxes or regulatory costs, or substantial changes to the features a plan includes. A change never applies to a period you have already paid for. If the price of your website subscription changes we will tell you at least 30 days before it takes effect, and you can cancel before then if you do not want to continue. For an App Store subscription, Apple tells you about a price increase and asks for your agreement where its rules require it, and you can cancel before the new price applies. Nothing in this clause limits any further notice or cancellation rights you have by law.
16. Changing or withdrawing the service
We may add, change or remove features. If we make a change that removes a significant part of what your paid plan provides, or if we stop offering it, we will tell you and refund the unused part of any period you have paid for. You can always export your data and delete your account.
17. Suspension and misuse
We may suspend or end a subscription where an account is used in breach of these terms, for example by sharing one account between several people or by attempting to bypass the usage allowances. Where we end a paid subscription for that reason we will refund the unused part of the current period unless the breach caused us loss.
18. Deleting your account
Deleting your account cancels any active website subscription immediately and deletes your data as described in the Privacy Policy. We do not refund the remainder of a period you have paid for, and cancelling through Manage billing before deleting keeps your access to the end of that period.
Deleting your account, or uninstalling the app, does not cancel a subscription bought through Apple or through Google Play, and that store will keep charging you until you cancel it in your Apple account's subscription settings or at play.google.com/store/account/subscriptions. Before you confirm deletion, the app tells you this and offers a link to those settings. You can still delete your account straight away. Deleting your account does not remove any legal right you have to a refund or other remedy.
19. Availability
We work to keep FitTech-AI running and your data safe, but we cannot promise it will always be available or free of errors. We may change, pause or stop parts of the service, and we will try to give notice of significant changes.
20. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your legal rights as a consumer.
- Otherwise we are not responsible for loss that was not foreseeable, for loss caused by using the service against its safety guidance, or for business losses, since FitTech-AI is for personal use.
21. Changes to these terms
We may update these terms. We will change the date at the top, and tell you in the app or by email before a significant change takes effect. If you do not agree, you can stop using FitTech-AI and delete your account. Accepting updated terms is separate from your consent to health data processing, which we only ever ask for on its own (clause 23).
22. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in another country, you keep any mandatory consumer protections of where you live and may be able to bring a claim in your local courts. Please contact us first so we can try to resolve any problem.
23. Health data from your phone
Connecting Apple Health on iPhone or Health Connect on Android is optional, and you can use FitTech-AI without it. Before anything is read, the app explains what it reads and why and asks for your explicit consent, and your phone then asks you to allow each type. Accepting these terms does not give that consent.
FitTech-AI reads only the types you allow (steps, active energy, total calories burned, resting energy, heart rate, resting heart rate, heart rate variability, VO2 max, workouts and sleep) to show them in the app and use them in your calorie balance, plan and coaching. We only read this data; we never write to Apple Health or Health Connect. We never sell it, and never use or share it for advertising or marketing.
You can stop the app reading it at any time in Settings, Health data, and withdraw access in your phone's settings. Withdrawing your consent in Settings, Health data stops reading on all your phones and deletes what was already read. Turning reading off on one phone does not by itself delete what was already read; you can delete that in Settings, Health data, or by deleting your account. Withdrawing consent does not affect processing before you withdrew it. How long we keep this data, and who processes it, is explained in our Privacy Policy.
Phone measurements, and anything worked out from them, can be incomplete or wrong. They are fitness information, not a diagnosis, treatment or emergency monitoring (clause 4).
24. Reminders
The apps can remind you about sessions and check-ins. Reminders are off until you turn them on and allow notifications, and you can turn them off at any time in the app's Settings or your phone's settings. They are scheduled on your phone, so delivery depends on its settings. They are not medical or emergency alerts. Turning them off does not stop essential account, security or legally required messages.
25. Apps from the App Store and Google Play
If you downloaded the FitTech-AI app from Apple's App Store, your licence to use the app software is governed by Apple's standard Licensed Application End User License Agreement, and your use must follow Apple's Media Services Terms and Conditions. If you downloaded it from Google Play, your use must follow the Google Play Terms of Service. These terms govern the FitTech-AI service and your account and subscriptions. These terms are between you and SAGUNI LTD, not Apple or Google. SAGUNI LTD, not Apple or Google, is responsible for FitTech-AI, its content, its maintenance and support, and any claims about it.
